Limitation of Liability

1. No Warranty
Bokora provides its platform on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
2. Cap on Liability
To the fullest extent permitted by applicable law, Bokora's total aggregate liability to you for any claims arising out of or related to your use of the platform — whether in contract, tort, negligence, or otherwise — shall not exceed the total fees paid by you to Bokora in the twelve (12) months preceding the event giving rise to the claim, or £100, whichever is greater.
3. Exclusion of Consequential Damages
In no event shall Bokora, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data or information
- Loss of goodwill or reputation
- Business interruption
- Personal injury or property damage arising from your use of, or inability to use, the platform
This exclusion applies even if Bokora has been advised of the possibility of such damages.
4. Third-Party Actions
Bokora is not liable for the acts or omissions of any host, hotel, guest, or third party accessed through the platform. We do not control and are not responsible for the quality, safety, legality, or suitability of any property listed on Bokora, nor for the accuracy of any listing information provided by hosts or hotels.
5. Payment and Financial Losses
Bokora is not liable for any losses arising from payment failures, bank errors, currency fluctuations, or fraudulent activity by third parties. You are responsible for ensuring your payment details are accurate and secure.
6. Force Majeure
Bokora shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, war, terrorism, or infrastructure failures.
7. Jurisdiction-Specific Rights
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law. Nothing in these terms affects your statutory rights as a consumer.
